Fitnic Terms of Use

Please read these Terms before using Fitnic. The sections about exercise safety, AI-generated recommendations and subscriptions are particularly important.
1. Agreement to these Terms
These Terms of Use govern your access to and use of the Fitnic mobile application, website, AI-assisted features, workout plans, support services and related functionality operated by DigitMind Technologies. By creating an account, purchasing a subscription or using Fitnic, you agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 16 years old, or the higher minimum age required where you live, and legally able to enter into this agreement. If you use Fitnic on behalf of another person or organization, you confirm that you are authorized to accept these Terms for them.
3. Fitness and medical disclaimer
Fitnic provides general fitness, wellness and educational information. It does not diagnose, treat or prevent disease and is not medical advice, emergency assistance or a substitute for a physician, physiotherapist or other qualified professional. Consult a professional before beginning or changing an exercise program if you have pain, injury, pregnancy, a medical condition or other risk factors.
4. Exercise safety
You are responsible for selecting a safe environment, suitable equipment and an appropriate level of effort. Review exercise instructions before starting, use proper technique and stop if an activity feels unsafe. Seek immediate help for chest pain, faintness, severe shortness of breath, acute pain or other concerning symptoms.
5. AI-generated plans and coaching
Workout plans, substitutions, explanations and coach responses may be generated or assisted by artificial intelligence. AI output can contain errors, omit important circumstances or be unsuitable for you. Fitnic does not independently verify your physical readiness. You must use judgment, keep your profile current and obtain professional advice when appropriate.
6. Personalization information
Fitnic relies on information you provide about your goals, experience, schedule, equipment, preferences, limitations and recent pain. You are responsible for providing accurate information and updating it when circumstances change. Recommendations may be less relevant or less safe when information is incomplete or outdated.
7. Your account
You may need an account to use some features. You must provide accurate registration information, maintain the confidentiality of your credentials and promptly notify us if you suspect unauthorized access. You are responsible for activity through your account unless applicable law provides otherwise.
8. License to use Fitnic
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable license to use Fitnic for lawful personal fitness and wellness purposes. No ownership rights in the software, content or brand are transferred to you.
9. Acceptable use
You may not misuse Fitnic, interfere with its operation, bypass security or payment controls, scrape or extract content at scale, upload malicious code, impersonate another person, use the service for unlawful purposes, attempt unauthorized access, reverse engineer the software except where law expressly permits, or use Fitnic to build a competing dataset, service or model.
10. User content and communications
You retain ownership of information, prompts, feedback and other content you submit. You grant us a worldwide, non-exclusive license to host, process, reproduce and adapt that content only as reasonably necessary to operate, secure and improve Fitnic, provide requested AI features and comply with law. You must not submit content that is unlawful, harmful or infringes another person’s rights.
11. Feedback
You may send suggestions or feedback about Fitnic. We may use feedback without restriction or compensation, provided that doing so does not identify you publicly without permission.
12. Free and paid features
Some Fitnic features may be free, while others may require a subscription or one-time purchase. Available features, pricing and limits may differ by platform, country, account status or promotional offer. The current purchase screen controls if it conflicts with general marketing text.
13. Trials and promotional offers
A trial or promotional period may convert to a paid subscription unless cancelled before the stated deadline. Eligibility may be limited to new users or one offer per account. Trial length, price after trial and renewal terms are displayed before purchase.
14. Billing and automatic renewal
Subscriptions purchased through Apple, Google or another marketplace are billed by that marketplace and may renew automatically until cancelled. You authorize the marketplace to charge the payment method associated with your account according to the displayed billing period and price.
15. Cancellation
You can cancel through the subscription settings of the marketplace used for purchase. Cancellation generally takes effect at the end of the current billing period. Deleting the app or your Fitnic account does not automatically cancel an active app-store subscription.
16. Refunds
Refund requests are generally handled by the marketplace that processed the payment and are subject to its rules and applicable consumer law. We do not control whether Apple, Google or another marketplace approves a refund.
17. Changes to prices and subscriptions
We may change subscription options, included features or prices. Where required, price changes will be communicated in advance and applied according to marketplace rules. You may cancel before a new price takes effect.
18. Intellectual property
Fitnic, its software, visual design, branding, text, training content, graphics, exercise materials, databases and related intellectual property are owned by DigitMind Technologies or its licensors and are protected by applicable laws. Except for the limited license above, no rights are granted.
19. Third-party services
Fitnic may rely on services provided by Apple, Google, authentication providers, cloud platforms, analytics tools, AI providers, payment processors or device integrations. Their availability, terms and privacy practices are outside our direct control. Fitnic is not responsible for third-party outages or changes.
20. Apple-specific terms
If you download Fitnic from the Apple App Store, these Terms are between you and DigitMind Technologies, not Apple. Apple has no obligation to provide maintenance or support. To the extent required by Apple’s standard terms, Apple and its subsidiaries are third-party beneficiaries entitled to enforce the applicable provisions.
21. Service availability and changes
We may add, remove, modify, test, suspend or discontinue features, content, integrations or plans. We do not guarantee uninterrupted availability, compatibility with every device or that any particular exercise, AI model or feature will remain available indefinitely.
22. Updates
Fitnic may require software updates for security, compatibility or new features. Some functionality may stop working if you do not install an available update or if your operating system is no longer supported.
23. Suspension and termination
You may stop using Fitnic at any time. We may limit, suspend or terminate access when reasonably necessary for security, legal compliance, non-payment, abuse, repeated violations or a material breach of these Terms. We may preserve records when required by law or for legitimate security purposes.
24. Disclaimer of warranties
To the maximum extent permitted by law, Fitnic is provided as is and as available. We do not guarantee that recommendations will be accurate, suitable for every user, error-free or produce a particular fitness result. Individual outcomes depend on many factors outside our control.
25. Limitation of liability
To the maximum extent permitted by law, DigitMind Technologies is not liable for indirect, incidental, special, consequential or punitive damages, loss of data or profits, or injuries resulting from unsafe exercise, incorrect inputs, failure to follow warnings or reliance on AI-generated output. Any aggregate liability is limited to the greater of the amount you paid for Fitnic during the preceding twelve months or USD 100, unless applicable law requires otherwise.
26. Indemnity
To the extent permitted by law, you agree to indemnify DigitMind Technologies against third-party claims arising from your unlawful use of Fitnic, violation of these Terms or infringement of another person’s rights. This provision does not apply where prohibited by consumer law.
27. Governing law and disputes
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law principles. Unless mandatory consumer law provides otherwise, disputes are subject to the courts located in Astana, Kazakhstan. Before filing a formal claim, the parties should first attempt to resolve the matter through Support.
28. Consumer rights
Nothing in these Terms limits rights that cannot lawfully be excluded, including mandatory consumer protections available in your country. If a provision conflicts with a non-waivable right, that right will control to the extent of the conflict.
29. Changes to these Terms
We may update these Terms as Fitnic evolves or legal requirements change. The revised version will show a new effective date. Material changes may be announced in the app, on the website or through another appropriate channel. Continued use after the effective date means you accept the updated Terms where permitted by law.
30. General provisions
If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. We may assign these Terms as part of a merger, acquisition, reorganization or transfer of the service. You may not assign your rights without our consent.
